The Egyptian Competition Authority (ECA) has been very active recently. I would like to propose a few suggestions that could enhance ECA's performance. First, ECA should consider issuing Guidelines that reflect ECA's interpretation of the Egyptian Competition Law (ECL) no. 3 / 2005 the same way other competition agencies do in other countries. Such Guidelines would help practitioners to reflect ECA's understandings in their legal opinions to clients seeking compliance with ECL. Second, as several companies seek ECA's opinion regarding the legality of future plans, ECA should offer alternatives to the existing mechanism ECA adopts. ECA requires a company to make a complaint against itself in order for the ECA to express its opinion in the case. Of course, many companies, for many legal and practical reasons, would not be comfortable to proceed with this mechanism.
جهاز حماية المنافسة المصري له نشاط ملحوظ خلال الفترة الحالية. ولعل من المفيد دراسة الملاحظات التالية، لعلها تجد فرصة لتنفيذها او بعضها. اتمنى اولا ان يصدر الجهاز القواعد الارشاديه التي يعتبرها تفسيرا للقانون -مثلما تفعل اجهزة مشابهة في دول اخرى-، كي يتسنى للشركات توخى الحذر وتجنب مخالفة القانون قبل البدء في النشاط المشكوك في توافقه مع القانون. اتمنى ثانيا ان يجد الجهاز حلا بديلا لما هو قائم بالنسبة للشركات الراغبة في معرفة مدى توافق ممارسه ما مع القانون. الجهاز حاليا يتطلب من الشركة ان تقدم بلاغا او شكوى ضد نفسها كي يتسنى للجهاز فحص الحالة وإبداء الرأي. لكن شركات عديدة قد لا ترغب في إتباع هذا الإسلوب لأسباب واعتبارات قانونية عديدة، وهو ما يستدعي ضرورة ان يتيح الجهاز بدائل أخرى غير تقديم الشركة شكوى ضد نفسها
