Comparing societies is important and also tricky. It is true that what might work for a society might not work for another. But it is also true that there are some commonalities that are essential for the development of a society regardless of what form of government in such a society. One who conducts a comparative study of law in two societies easily recognizes this matter and recognizes that what might look an essential difference between the two societies could turn out to be a commonality but the two societies are in two different stages of recognizing the proper solutions for a common problem. That is what I though of when I came across news that New York to pay $2.7M over troopers' handling of 1997 Onondaga Nation protest
المقارنة بين المجتمعات مهمة. ومع الإعتراف أن ما يجري عمله في مجتمع ما لا يصلح بالضرورة عمله في مجتمع آخر، إلا ان من المهم تمييز ما هو أساسي لأي لتطور اي مجتمع ولطريقة حكم هذا المجتمع أياً كانت الصورة التي تظهر فيها الدولة في هذا المجتمع. ومن تُتاح له فرصة إجراء دراسة قانونية مقارنة بين مجتمعين يدرك أن ما قد يبدو ظاهره اختلافاً جذرياً بين مجتمعين قد تُثبت الدراسة المتعمقة أنه أمر مشترك بين المجتمعين وليس اختلافاً. كل ما هناك أن احد المجتمعين سبق الآخر في إدارك أهمية أمر ما فبت أمره واتخذ قراره بشأنه، وهو ما سيفعله المجتمع الآخر ولو بعد حين. تذكرت ذلك وأنا أقرأ خبراً عن موافقة قاضي أمريكي على تسوية بقيمة 2.7 مليون دولار تمت بين ولاية نيويورك و 76 مدعياً طالبوها بتعويض عن إستخدام الشرطة لقوة مفرطة أثناء فض مظاهرة
